Page Six reports: Hips don't lie - and they don't fly either. That's what one woman discovered the hard way when she took part in an East Side bar's "Shake it Like Shakira" contest - and apparently shook it so hard she ended up on the ground in agony. Now Megan Zacher, 22, has filed suit against Calico Jack's Cantina, saying the bar "knew or should have known that the 'Shake It Like Shakira' promotion was dangerous and likely to lead to injury." Zacher's lawyer, Lawrence Simon, said his client was only on her second drink when she joined in on the booty-shaking contest on the saloon's bar.
"We don't believe alcohol was a factor, although it probably was for some of the other dancers," Simon quipped. The incident happened on July 8, when Zacher went to the bar on Second Avenue near East 42nd Street at around 10:30 p.m. to celebrate a friend's birthday. Simon said the New Jersey resident had had a margarita and just started drinking a Bacardi and Coke when she decided to throw her rear end into the contest, which is named for the bountifully bootied "Hips Don't Lie" singer Shakira. The grand prize for the popular weekly competition is $250, but Zacher didn't get to qualify for the butt-shaking bounty. "She was caused to be precipitated and fall" because the "bar area was wet, unprotected and unsafe," the suit says.
Simon said that even though eight to 10 women were dancing on the bar, bartenders "continued serving drinks and serving people at the bar."He said Calico Jack's staff wasn't exactly helpful after her spill. "They basically told her she couldn't stay where she was," he said. While the contest continued, Zacher was in so much pain that she and her friends had to leave, Simon said. He said when she went for medical help the next day, his client discovered her knee was seriously injured. "She required reconstructive surgery," Simon said. The suit seeks unspecified money damages for her "severe and protracted personal injuries," and "great pain and suffering."
It also charges the bar with negligence for "failing to warn customers of the hazards" of shaking it like Shakira. At her Delanco, N.J., home yesterday, the perky blonde declined to comment, but walked with a slight limp. The Wagner College grad, who said she works as a paralegal, says on her MySpace page that she's a fan of "Spanish music (which I love dancing to.)" Ads for Calico Jack's boasted that the "Shake It Like Shakira" nights also feature $1 tacos and $3 margaritas. The East Side bar's Web site features numerous pictures from previous "Shake It" shindigs showing women competing in barely there outfits, and one woman dressed in just a bra and panties. A manager at the bar declined comment other than to say it no longer runs the contest.
